3. User Responsibilities and Conduct

As a user of UpLeveled.AI, you agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Use the Service only for lawful purposes and in accordance with these Terms
• Respect the intellectual property rights of instructors and other users
• Not engage in harassment, abuse, or inappropriate behavior during AI roleplay sessions
• Not attempt to reverse engineer, hack, or compromise the Service

4. Payment and Credit System

UpLeveled.AI operates on a credit-based payment system:

• Credits can be purchased through our platform using accepted payment methods
• Credits are used to access premium courses and AI roleplay sessions
• Some content may be available for free, while premium content requires credits
• Credit prices are clearly displayed before purchase
• All payments are processed securely through third-party payment processors

5. Refund Policy

All credit purchases are final and non-refundable. Once credits are purchased and added to your account, they cannot be refunded, exchanged for cash, or transferred to another account. This policy applies regardless of whether the credits have been used to access content.

In exceptional circumstances involving technical issues or billing errors, we may consider refund requests on a case-by-case basis at our sole discretion.

6. Instructor Content Ownership and Licensing

For instructors who publish courses on UpLeveled.AI:

• You retain ownership of your original course content and materials
• By publishing content, you grant UpLeveled.AI a non-exclusive license to host, distribute, and promote your content
• You represent that you have the right to publish all content and that it does not infringe on third-party rights
• You are responsible for the accuracy and quality of your course content
• UpLeveled.AI may remove content that violates our Community Guidelines or these Terms

Revenue sharing terms for instructors are governed by separate instructor agreements.

7. Disclaimers and Limitation of Liability

Disclaimer: The Service is provided "as is" and "as available" without warranties of any kind. UpLeveled.AI does not guarantee that the Service will be uninterrupted, secure, or error-free.

Educational Content: Course content is for educational purposes only and should not be considered professional advice. Users should consult qualified professionals for specific guidance.

Limitation of Liability: To the maximum extent permitted by law, UpLeveled.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the Service.

8. Termination of Accounts

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of our Community Guidelines
• Fraudulent or illegal activity
• Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. Unused credits will not be refunded upon account termination.

9. Governing Law

These Terms shall be interpreted and governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Delaware.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
